A three-member panel called the Neighborhood Accountability Board, staffed by trained volunteers, meets with the offender, the offender's parents and the victim. The board comes up with a 90-day plan of specific tasks for the offender to make amends, take responsibility and avoid arrest.

 

A caseworker must verify that each step in the plan is accomplished by the deadline.

 

For example, here is the plan the board recently wrote for a 15-year-old boy accused of battery on another student at school. The board requires:

 

• Separate, written letters of apology by the boy to his parents, principal, school resource officer and victim, a boy who had suffered bullying from others as well.

 

• Six essays. One essay is about how he would feel if he were a victim and it is to be delivered to his victim. Other topics include personal responsibility and decision making, juvenile criminal law, consequences of having a felony conviction, consequences of being arrested as a juvenile and the state statute outlawing the sending of sexually explicit text messages.

 

• 25 hours of community service and substance abuse training with Drug Free Charlotte County.

 

• 25 hours of community service at a Punta Gorda historical park.

 

• A five-hour tour of the county jail in which he will go through a mock booking and inmates will give him a “Scared Straight”-type lecture about what he can expect if he is ever jailed.

 

• Weekly random testing for drugs and alcohol. Failure to pass any test means he will be dropped from the program and a warrant will be issued for his arrest in the battery case.

 

• Eight anger management counseling sessions.

 

If a defendant's parents cannot afford some of the sanctions, such as counseling or drug testing, Jack Sanzalone, the county's neighborhood accountability coordinator, will contact sources that may provide financial assistance.

 

If the offender or parents do not complete the required sanctions by the deadlines, the case is referred to state prosecutors.

 

If the juvenile successfully completes the program, no criminal case is filed. No arrest record exists. The court system does not get involved.

But North Port leaders say those programs tend to be based in Sarasota and are not always accessible for families in their city.

Teen Court, for example, is a program in which the defendant admits guilt before an adult judge but the sentence is determined by a teenage jury. The hearings are conducted at the Sarasota and Venice courthouses.

Teen Court received 97 referrals of juveniles with North Port addresses in the previous fiscal year. North Port Police referred 49 of them. Others were referred by schools, prosecutors or the Florida Department of Juvenile Justice.

Carusone leads the North Port Community Health Action Team, a committee that works with Sarasota County Health and Human Services and other agencies on local issues. CHAT is exploring ways to create diversionary programs in North Port, where juvenile offenders can participate without commuting to another city and be monitored more closely and frequently.

One option is to establish a satellite Teen Court in North Port, perhaps at the police station, CHAT members say.

CHAT is especially interested in a concept used in Charlotte, where a Neighborhood Accountability Board enacted in 2006 is touted as having a high success rate.

After offenders complete the 90-day program, “93 percent don't re-offend within a year of tracking them,” said Jack Sanzalone, neighborhood accountability coordinator for Charlotte County Human Services.

Giving police a choice

The state-approved program, variations of which are used in several other Florida cities and counties, gives law enforcement officers the option of issuing a juvenile offender a civil citation instead of making an arrest.

“The police officer makes the determination,” Sanzalone said.

The offender must have committed a misdemeanor.

The citation recipient, the juvenile's parents and the victim appear before a Neighborhood Accountability Board. The board is comprised of three volunteers who have undergone background checks and training.

“You have these volunteers for a reason,” Sanzalone said. “The community is making the decision (about what to require of the offender), not me.”

Sanzalone works with Charlotte County Young Professionals to recruit volunteers for the panels. He believes offenders respond better if they are being judged by young adults, with whom they can more easily identify. Successful young adults can be role models for the offending teenagers, Sanzalone said.

The juvenile must admit guilt. If not, he or she will be arrested.

The victim confronts the offender and tells what consequences he or she has endured because of the crime.

North Port Police Chief Kevin Vespia said including the victim in the procedure is crucial. “They (offenders) need to see the impact they've had on the victims' lives. Sometimes, you don't realize the consequences of what you did.”

The board discusses with the parents what they are or are not doing to properly supervise and guide their child.

The parents must agree to cooperate. If they want to decline, Sanzalone said, they are advised that “they can look their child in the face and tell them they'll now get arrested.”

The volunteer board creates a contract with the juvenile and parents outlining what must be accomplished during the next three months. Tasks could include apology letters, community service, a jail tour, counseling, drug tests and more.

“This program has teeth,” Sanzalone said. “It's not a pass. We make them work.”

Charlotte County spends about $488 on each juvenile in the NAB program, for which it gets reimbursed by the Department of Juvenile Justice, Sanzalone said.

Most juvenile offenders, Vespia said, “got on the wrong road or the wrong path or lost direction somewhere.” He believes that, with guidance, they can get their lives back on a proper course.

Yet for police officers to use any diversionary program at their discretion, Vespia said, they will have to be convinced that it works.

If they see the same juvenile offenders “again and again,” Vespia said, they will lose faith in a diversionary program and instead use their arrest powers.

“The credibility of the program is very important,” Vespia told CHAT members.

Sanzalone believes youths who are first-time offenders should be given a second chance because they are not mature adults.

“I'm passionate about the civil citation because it doesn't leave a mark, it doesn't leave a scar,” Sanzalone said.

The NAB approach is not just about punishment but about treating “the whole child,” Sanazlone said. “If you don't treat the whole child, you're just treating the symptom. You're putting a Band-Aid on a six-inch gash. The process is not going to work.”

It was only afterwards that it struck me: that might be the first time in my entire life that I have laughed out loud because of something that Mickey Mouse did.Animation is one of my favorite things about the existence of movies. I cannot overstress how much I love the entire idea of animation, and from childhood on, I have watched anything and everything I could. I spent many of my childhood years in Florida, close enough to Walt Disney World that we went as often as eight or nine times a year. It's easy to see how large a shadow Disney animation has cast over the entire art form, and there is no denying that Mickey Mouse is an icon, instantly recognizable around the world.The simple truth when I was younger, though, was that Warner Bros. cartoons were simply funnier than Disney's cartoons. Bugs Bunny, Daffy Duck, Wile E. Coyote, Porky Pig… I'm not even sure I could count all the times those characters have made me howl. With Disney's short cartoons, I can enjoy watching them because the artistry is so gorgeous, but aside from Goofy, there are very few of those cartoons that I re-watch simply to enjoy them.Mickey starred in over 130 films, and many of his shorts were nominated for Academy Awards, including 1942's winner, "Lend A Paw." He was seen in comic books, comic strips, on TV, and as recently as "Epic Mickey 2," starring in major video game titles. He has been the face of the studio, alongside Walt Disney himself, as long as he's been in existence. But why? What made Mickey such a stand-out?He was originally designed to replace Oswald The Lucky Rabbit, Disney's earlier creation, and it was a pretty direct response to Disney's fury over losing the legal rights to Oswald. Ub Iwerks and Walt Disney tossed character designs back and forth, trying dogs and birds and cats and cows before they finally landed on the idea of a mouse. In his earliest designs, Mickey is the very model of simplicity, a series of interlocked circles. His body was, in the style of many of the cartoons of the day, all "rubber hose." From the moment "Steamboat Willie" was released, Mickey was in pretty much constant redesign, evolving slowly but surely into the version of the character that is imprinted on roughly 10 zillion products at all times these days.What I find fascinating about his continued presence on all things Disney is that Mickey isn't particularly active as a character, which makes me wonder what kids think of him in general. I can't use my own kids as an example because they're exposed to more media than most people thanks to the ridiculous library of films we have in the house. They've seen old black-and-white Mickey cartoons and they've seen the color cartoons, and they've played the "Epic Mickey" games and they're actually big fans of "Fantasia." They showed 11 or 12 cartoons from 1928 through 1941 (followed by Get a Horse!, which was SO great), and after laughing at plenty of stuff in the first few, I was wondering why I also always think of the Disney cartoons being technically lovely or cute or fun to watch, but not actually funny. And I'm sure that's the case for plenty of them (including a couple from later in that same screening), but I think another difference is how verbal the Looney Tunes are compared to the Disney shorts. They've got attitude, and the characters' voices and dialogue is as memorable as any funny animation. Donald is semi-unintelligible (which can be really funny itself), but Mickey and Minnie don't do so much talking, and even when they do it's mostly functional and not for comedy. The Looney Tunes are also so conflict driven and really pit characters against each other in a way that the Disney cartoons tend to eschew in favor of more gag-based comedy. Pluto can spend half a short doing slapstick with flypaper while Daffy Duck is trying to get Elmer Fudd to shoot Bugs in the face. Plus, as you say, you can certainly see a kind of smoothing-out and suburbanization of Mickey as the cartoons go on.But between Epic Mickey, Fantagraphics' reprints of the Floyd Gottfredson Mickey Mouse comic strip, those fun new shorts they've done for the Disney channel, and now Get a Horse!, I feel like they're making some effort to give Mickey something of a personality again.
